GENERAL TERMS AND CONDITIONS FOR USE OF THE WEBSITE

“Centre for Postcapitalist Civilization” a non-profit organization, incorporated under the Greek laws with comp. number 155505701000 with offices in 16, Mavrommateon street, Athens PC10682, email: [email protected]  (hereinafter “mέta”) created and manages the website www.metacpc.org  hereinafter referred to as the “Website”) in order to promote its statutory purposes.  

These General Terms and Conditions of Use (hereinafter referred to as the “Terms”) govern the use of the Website. User must read Terms carefully as they constitute a legally binding agreement between the User and mέta regarding the use of the Website.  The Website is addressed only to natural or legal persons with full legal capacity who can enter in legally binding agreements under applicable law.

  1. Agreement with the Terms.

Any User who uses the Website is deemed to have read, understood and unconditionally accept the Terms and undertakes to fully and at all times comply with them.  If User disagrees with the Terms, he must not make use of the Website. The use of the Website presupposes and constitutes a practical and unconditional acceptance of the Terms. Terms constitute the overall agreement between the User and mέta and binds only them.

The Website and entire content of the Website  (including without limitation all software and all graphics, user interfaces, text, photos, digital phonograms, programs, representations source code, news, articles, information, data, drawings, illustrations, trademarks, distinctive marks, names, logos, product names, company names, services provided etc., and in general, archives of every kind) is subject to copyright which belongs exclusively to the mέta or its content suppliers and are governed and supplemented by applicable National , European and International relevant legislation. The User hereby acknowledges and agrees that mέta retains all rights, titles and interests in and to the Website and its content. mέta reserves the right to take all measures and actions to defend its rights and seek all remedies available for any violation of the Terms.

Nothing on the Terms shall be construed as granting, assigning or transferring any intellectual property license or rights to the User without the prior specific, written consent of the mέta. Any copying, reproduction, republication, transfer, storage, processing, transmission, distribution, sale, issuance, execution, loading (download), translation or modification in any manner, communication, dissemination or any other use of Website and the content in any manner or means, for commercial or other purposes whatsoever, in part or in summary form, is prohibited without the prior written consent of the mέta

Exceptionally, individual storage and copying, reproduction, republishing, transmission or distribution of parts of the content on a simple personal computer is permitted for strictly personal use, without the intention of commercial or other exploitation and always subject to the reference of their source of origin, without this in any way meaning the granting of any intellectual property rights.

The content that appears on the Website and bears the mark of other organizations, companies, associations or generally that belongs to third parties is their own intellectual property and within their sphere of responsibility. For the use and exploitation of the material belonging to third parties, the User should contact the holders of the relevant Intellectual Property rights to obtain the necessary licenses and rights.

mέta has not agreed and does not agree to treat as confidential information any proposal or idea for the improvement or modification of the Website in any way. The User acknowledges and agrees that mέta reserves the right to use, benefit from, disclose, publish, keep secret or otherwise exploit such proposals or ideas and without any obligation of compensation.

These websites are not subject to the principles set forth herein but to their respective terms of use which User must read carefully. mέta bears no responsibility for the availability, content, privacy policy, quality and completeness of the services and in general for the compliance with the applicable legislation. The User will use these links at his own risk and for any problems that may arise during the visit to these websites, the User should contact the administrators of the respective websites.

  1. General Obligations of the User.

The User agrees, represents and warrants to comply with all relevant Greek, European and International laws and regulations, including the laws concerning the protection of intellectual property, protection of personal data, protection of fair competition, etc. the use of the Website must comply with accepted principles of morality and Terms of Use.

The User agrees, represents and warrants that will not provide false information about himself; impersonate any other person; send spam or mass mail, nor multiple copies of messages; as well as will not collect information about other users, without their consent.

Non-compliance of the User with the applicable laws and / or the Terms, gives the right to mέta to take all the necessary measures and actions to address User’s behavior (to deny access or delete, edit or move messages, etc.).

To the extent permitted by applicable law, User agrees, represents and warrants that User shall defend, indemnify, and hold harmless mέta and its associates of any liability against any claim, lawsuit, action against them and against any relevant liability, damage, penalty, fine, cost or expense (including reasonable attorneys’ fees and other legal costs) incurred by mέta or its associates due to, arising out of, or relating to, acts or omissions against the applicable laws or the Terms.

Data Security. mέta exercises reasonable care in safeguarding Users’ data according to the principles of Confidentiality, Integrity and Availability (CIA). mέta has adopted and maintains data security policies and procedures that contain organizational and technical measures appropriate to the complexity, nature, and scope of its activities, in order to protect User data against unauthorized access, processing, disclosure, destruction, damage or loss.

Personal Data. In accordance with the applicable provisions of national and European law (GDPR), mέta undertakes to make every effort to ensure that User’s personal data: are obtained and processed in a lawful, fair and transparent way; are maintained for as long as necessary to provide its Services or to comply with its legal obligations, resolve disputes, avoid abuses and enforce our agreements; are collected for specified and legitimate purposes and used in accordance with these purposes; are appropriate, consistent and not excessive in relation to these objectives; are accessible and subject to the rights to be recalled, modified or deleted upon request.

If any term of the Terms is deemed invalid or illegal or inapplicable it will be reformed to the maximum permitted by law as close as possible to the invalid or illegal or inapplicable term. If this is not possible, it will automatically be deemed not applicable and will be removed from this document without affecting the validity and validity of the remaining terms.

mέta reserves the right, to unilaterally modify the content of the Website, as well as the Terms, whenever it deems necessary, without prior notice, always in accordance with the applicable legal and regulatory framework.
